Terms of Service

1. Welcome

These Terms of Service ("Terms") govern your use of the Locale mobile app and the localecard.com website (together, the "Service"), operated by Locale Technologies LLC ("Locale," "we," "us"). By creating an account or using the Service, you agree to these Terms.

Please also read our Privacy Policy, which explains how we handle your data.

2. Who can use Locale

Locale is a verified, student-only marketplace for local deals. To create an account you must:

  • Be a student at a college or university that issues a .edu email address.
  • Use your own real .edu email address, which you control.
  • Confirm that email by clicking the link we send you.
  • Be at least 13 years old.

You may not create an account for anyone other than yourself, and you may not let anyone else sign in with your account or use your redemption codes.

3. Your account

You are responsible for the information you provide to Locale and for what happens through your account. You agree to:

  • Provide accurate information when you sign up and during onboarding (such as your first name and graduation year, if you choose to add them).
  • Keep your password private.
  • Notify us at support@localecard.com if you believe someone else has gained access to your account.
  • Stop using the Service if you are no longer eligible (for example, you graduate and no longer have an active .edu email).

You can delete your account at any time from the app. See section 8 for details.

4. How redemption works

Each offer on Locale is created and posted by a participating local business. When you tap Redeem on an offer:

  • Locale generates a six-digit redemption code that is valid for a short period (about five minutes).
  • You show the code to staff at the business so they can confirm it through their Locale dashboard.
  • Each code is single-use. Once it is confirmed or expires, it cannot be used again.
  • Codes are tied to your account. You may not share, sell, screenshot for others, or otherwise transfer your codes.

Discounts are applied by the business directly at the register. Locale does not process payments and is not a party to the underlying transaction between you and the business.

5. Businesses and their offers

Each offer on Locale is posted by a business and reviewed by the Locale team before going live. The terms shown on each offer (such as expiration date, eligible items, and any limits) are set by the business and apply to that offer.

Participating businesses agree to honor their own approved offers when a Locale code is shown in person and the offer's posted terms are met. A business may decline a redemption when:

  • The posted terms of the offer are not met (for example, the offer requires a minimum purchase that was not met, the item is out of stock, or the offer has expired).
  • The business reasonably suspects fraud, abuse, or that the code is being used by someone other than the verified student.
  • Applicable law requires them to decline (for example, an offer involving age-restricted products).

Locale is a directory and verification service. We help students discover offers and help businesses prove that the person redeeming is a verified student. We do not guarantee that every business will accept every redemption, and we are not responsible for the quality, safety, or accuracy of the goods or services provided by businesses.

If you believe a participating business is unreasonably refusing a valid Locale offer, email support@localecard.com and we will look into it.

6. Acceptable use

When you use Locale, you agree not to:

  • Misrepresent who you are, what school you attend, or your eligibility for student verification.
  • Share, sell, or transfer your account, your redemption codes, or your access to Locale.
  • Use Locale to harass, threaten, or harm any other student, business, or member of Locale staff.
  • Attempt to scrape, mirror, or systematically harvest data from Locale or from any business listing.
  • Reverse engineer, decompile, or attempt to extract the source code of the app or the Service, except where applicable law allows.
  • Interfere with, probe, or disrupt the Service or any related infrastructure, including by automated means.
  • Use the Service in a way that violates any applicable law, regulation, or third-party right.

7. Enforcement

We may remove an offer, pause your account, or terminate your account at any time if we believe in good faith that you have violated these Terms, engaged in fraud or abuse, are no longer eligible for student verification, or are putting other users or partner businesses at risk.

When we can do so reasonably, we will let you know and explain why. Where we believe immediate action is needed, we may act first and notify you afterward.

8. Deleting your account

You can delete your Locale account at any time from inside the app: Profile, then Delete account. Deletion is processed immediately by a secure server function. See our Privacy Policy for details on what gets deleted, what we keep as a small audit record, and what to do if a deletion does not appear to complete.

9. Changes to the Service

Locale is a young product, and we will keep changing it. We may add or remove features, change the look and feel, change which categories of offers are supported, or stop supporting a particular school. We will try not to break things you rely on without good reason.

10. Changes to these Terms

We may update these Terms from time to time. When we make a material change, we will update the effective date at the top of this page and, where appropriate, notify you inside the app or by email. Your continued use of Locale after a change takes effect means you accept the updated Terms. If you do not agree to the updated Terms, you may delete your account.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Locale disclaims all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error free, or free of harmful components, that any particular offer will be available at any particular time, or that any business will provide goods or services of any particular quality.

12. Limitation of liability

To the maximum extent permitted by law, Locale Technologies LLC and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with the Service, including loss of profits, goodwill, data, or other intangible losses, even if we have been advised of the possibility of such damages.

Locale does not currently charge students for use of the Service. To the extent Locale has any aggregate liability to you, that liability is capped at one hundred US dollars ($100).

13. Indemnification

You agree to defend, indemnify, and hold harmless Locale Technologies LLC from and against any claims, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of the Service.

14. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. You and Locale Technologies LLC agree to bring any dispute arising out of or related to these Terms or the Service exclusively in the state or federal courts located in New York, and you consent to the personal jurisdiction of those courts.

15. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Locale regarding the Service.

If any part of these Terms is found to be unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not transfer your rights under these Terms; we may transfer ours to an affiliate or successor.

This is the V1 launch version of Locale's Terms of Service. It is intended to honestly describe how the current product works. It has not been reviewed by counsel. Before broad public launch, Locale Technologies LLC should have an attorney review and update these Terms.
